Elder Abuse

Each year millions of older persons are abused, neglected, and exploited. Many victims are people who are older, frail, vulnerable, cannot help themselves and depend on others to meet their most basic needs. Abusers of older adults are both women and men, and may be family members, friends, or “trusted others.”

In general, elder abuse is a term referring to any knowing, intentional, or negligent act by a caregiver or any other person that causes harm or a serious risk of harm to a vulnerable adult. Legislatures in all 50 states have passed some form of elder abuse prevention laws. Laws and definitions of terms vary considerably from one state to another, but broadly defined, abuse may be:

  • Physical Abuse—inflicting physical pain or injury on a senior, e.g. slapping, bruising, or restraining by physical or chemical means.
  • Sexual Abuse—non-consensual sexual contact of any kind.
  • Neglect—the failure by those responsible to provide food, shelter, health care, or protection for a vulnerable elder.
  • Exploitation—the illegal taking, misuse, or concealment of funds, property, or assets of a senior for someone else's benefit.
  • Emotional Abuse—inflicting mental pain, anguish, or distress on an elder person through verbal or nonverbal acts, e.g. humiliating, intimidating, or threatening.
  • Abandonment—desertion of a vulnerable elder by anyone who has assumed the responsibility for care or custody of that person.
  • Self-neglect—characterized as the failure of a person to perform essential, self-care tasks and that such failure threatens his/her own health or safety.

What are the warning signs of elder abuse?

While one sign does not necessarily indicate abuse, some tell-tale signs that there could be a problem are:

  • Bruises, pressure marks, broken bones, abrasions, and burns may be an indication of physical abuse, neglect, or mistreatment.
  • Unexplained withdrawal from normal activities, a sudden change in alertness, and unusual depression may be indicators of emotional abuse.
  • Bruises around the breasts or genital area can occur from sexual abuse.
  • Sudden changes in financial situations may be the result of exploitation.
  • Bedsores, unattended medical needs, poor hygiene, and unusual weight loss are indicators of possible neglect.
  • Behavior such as belittling, threats, and other uses of power and control by spouses are indicators of verbal or emotional abuse.
  • Strained or tense relationships, frequent arguments between the caregiver and elderly person are also signs.

Most importantly, be alert. The suffering is often in silence. If you notice changes in a senior’s personality or behavior, you should start to question what is going on. Remember, it is not your role to verify that abuse is occurring, only to alert others of your suspicions.

Description:

421-LIFE (5433) is Hamilton County`s 24-hour elder abuse and neglect reporting line. Since 1981, Ohio has required counties to investigate reports of abuse, neglect, self-neglect and exploitation involving adults 60 and older.

Adult Protective Services (APS), a part of the Hamilton County Department of Job and Family Services, operates 421-LIFE. APS workers receive and investigate reports, identify risks to the safety and well-being of alleged victims, and work to improve situations by connecting older adults with social services and other resources. APS workers sometimes make referrals to police for criminal investigation.

APS workers cannot force older adults to take help. Mentally competent adults have the right to refuse APS assistance and intervention.

APS workers cannot make older adults go into nursing homes. In fact, APS is committed to helping adults stay in their own homes as long as they safely can, or helping them find the least restrictive alternative.

We urge you to become familiar with the warning signs of elder abuse and neglect contained in this brochure and call 421-LIFE if you have concerns. All calls are confidential.

More about Pro Seniors

Founded in 1975, Pro Seniors is a non-profit organization that provides free legal and long-term care help to older adults.  Pro Seniors offers Ohio residents age 60 and older the advice and information they need to solve their legal and nursing home, adult care facility, and home health care problems.

The Pro Seniors Mission
Pro Seniors is dedicated to helping older adults maintain their independence by empowering them, by protecting their interests, and by helping them access resources.

What Pro Seniors Offers
Pro Seniors Legal Hotline serves the State of Ohio.  By calling the Pro Seniors Legal Hotline, Ohio residents age 60 or older can receive free assistance over the telephone with a variety of legal or long-term care problems. In Greater Cincinnati, the number to call is (513) 345-4160.  In other parts of Ohio, call (800) 488-6070.  Find more information on the Legal Hotline by selecting the Legal Hotline link.

Legal Help
If you have a legal problem that cannot be resolved over the telephone, the Legal Hotline may refer you to a Pro Seniors staff attorney if you live in Butler, Clermont, Clinton, Hamilton or Warren County. Pro Seniors' staff attorneys handle problems that many private attorneys do not, such as Medicare, Medicaid, Social Security, other government benefits and pensions.  The Legal Hotline may also refer you to a private attorney who has agreed to accept cases at a reduced fee for clients with limited income.

Legal Information Pamphlets
Pro Seniors provides pamphlets on a variety of subjects, from Medicare and Medicaid to consumer fraud and food stamps.  You can find a complete list by selecting the Pamphlets link.

Long-term Care Ombudsmen
If you have a complaint about a nursing home, Pro Seniors can help.  The long-term care ombudsmen will investigate and work with you to resolve your concerns about nursing facilities in Butler, Clermont, Clinton, Hamilton, and Warren counties.  Pro Seniors ombudsmen also handle complaints about home care and adult care facilities.  You can find more information about the Ombudsman program by selecting the Ombudsman link. The Ombudsman can also help you choose the right care facility to meet your needs.

Volunteer Opportunities
If you are interested in assisting older people and have a few free hours each week, Pro Seniors offers a variety of volunteer opportunities.  For more information about our volunteer Ombudsman Program, select the Ombudsman  link.  If you are concerned about fraud and waste in the health care system, select the Ohio Seniors Fight Fraud  link to learn more about volunteering for this project.  If you are an attorney, you can assist callers to the Legal Hotline or conduct legal research.  Paralegals can provide valuable support to our legal staff. Volunteers also are needed to assist staff with mailings and other office projects.

Description:

The Warren County Department of Human Services is the mandated agency responsible for providing protective services for those adults sixty (60) years of age or older at risk of abuse, neglect, or exploitation. Any referral of an adult at risk will be investigated by the Adult Protective Service Worker. She will work with the adult, family and neighbors to reduce or eliminate any risk and arrange for services to assist the adult to remain safely in his/her home. Protective services such as casework, medical care, guardianship and legal services, food, clothing, and in-home care are utilized to prevent or reduce conditions causing endangerment to the older adult. If it is determined that the adult is incapacitated or unable to remain safely in his/her home, then the APS worker will work to determine the least restrictive setting and, if necessary, petition the probate court for assistance in protecting the adult.

If you would like more information on the Adult Protective Service Program, or if you wish to make a referral regarding an adult, please contact the agency at 513-695-1423 or 513-695-1454.
